Local Authority

There are two parts of a local authority search – a LLC1 and a CON29.

The LLC1 (Local Land Charge Register) covers any charges or attendant restrictions relating to land or property. These can include whether the property is:

  • A listed building
  • Located in a conservation area
  • Subject to tree protection order
  • In need of improvement or a renovation grant
  • Or situated in a smoke control zone

The form also holds information on planning agreements and conditional planning permissions. All LLC1 registrations are legally binding on successive owners.

The second component of the search – the CON29- supplies information relating to public highways, proposals for new roads, rail schemes or planning decision that could affect the property. It also covers outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order.

The search also covers Environmental factors like whether the house are situated on contaminated land or in Radon gas affected area.


What’s the difference between official searches and personal searches?

There are two types of land authority searches- official and personal.

The ‘official’ method involves sending forms directly to the local authority where a member of staff from the Local Land Charges Register conducts the search. This is then signed and stamped by a council officer.

The ‘personal’ method is conducted by an external agency unaffiliated with the council and works ‘independently’ from the same Register. In the majority of cases, this type of search is cheaper and usually quicker than an official application and are covered by specific information accuracy insurance policies as well as employer error liability.

More often that not, whether a personal or official search is undertaken is often determined by the mortgage lender, so it’s worth determining which one is required prior to spending unnecessarily for searches.
